Terms of Service

1. Description of the Service

Objektiv is an AI-powered personal image and appearance analysis platform. The Service accepts photographs you upload and returns observational signals — facial proportions, color season classification, body somatotype, skin readings, hair classification, outfit composition — together with calibrated scores and suggested improvements. Paid tiers also include a consultant chat, a closet manager, outfit generation, and virtual try-on previews.

The Service is provided for personal, non-commercial use. Outputs are AI-generated opinions intended as starting points for self-experimentation. They are explicitly not professional advice (see Section 7).

2. Eligibility and account

You must be at least 16 years old to use the Service. By creating an account you represent and warrant that you meet this age requirement and that the information you provide is accurate. You are responsible for keeping your account credentials confidential and for all activity conducted through your account. Notify us immediately if you suspect unauthorised access.

3. Acceptable use

You agree to use the Service only for its intended purpose and in compliance with applicable law. The following are strictly prohibited:

• Uploading photographs of any other person without that person's informed, prior consent. The Service is designed for self-analysis. Do not analyse strangers, ex-partners, public figures, or anyone else who has not agreed.
• Uploading photographs of minors under 16, including your own, without verifiable parental consent.
• Uploading any sexually explicit content, content depicting nudity of a sexual nature, or content depicting violence, self-harm, or other illegal material. The Service uses safety filters and we will terminate accounts that repeatedly attempt to bypass them.
• Using the Service to harass, defame, discriminate against, or threaten any person or group.
• Attempting to circumvent rate limits, tier gates, paywalls, or any other access control, including creating multiple accounts to extend free-tier limits.
• Scraping, crawling, or otherwise programmatically extracting content from the Service except through APIs we publish for that purpose.
• Reverse-engineering, decompiling, or attempting to extract the prompts, weights, or proprietary system instructions that power the AI features. The phrasing of our prompts is part of our trade secret.
• Interfering with the operation of the Service, including denial-of-service attacks, malware uploads, or probing for vulnerabilities outside a coordinated disclosure programme.
• Reselling, sublicensing, or commercially redistributing the outputs of the Service, including selling analyses-as-a-service, without a written agreement with Objektiv.

We reserve the right to investigate and take appropriate action — including content removal, account suspension, and account termination — against any user who, in our sole reasonable judgement, violates this section.

4. Subscriptions, billing, and refunds

4.1 Subscription tiers

The Service is offered on a free tier and on paid subscription tiers (Starter, Pro, Ultimate). Pricing and feature differences are listed on /pricing. We may change pricing for new sign-ups at any time; existing subscribers will be notified by email at least 30 days before any price change affecting their subscription, and may cancel before the change takes effect.

4.2 Billing

Paid subscriptions are billed in advance through Stripe, monthly or annually depending on the plan you select. Subscriptions auto-renew at the end of each billing period until cancelled. By providing a payment method you authorise Stripe, on our behalf, to charge that method for the recurring subscription fee plus any applicable taxes.

4.3 Cancellation

You may cancel your subscription at any time from Settings → Manage subscription. Cancellation takes effect at the end of the current billing period. You retain full access to paid features until that date. We do not prorate refunds for partial months or partial years — you keep what you have already paid for, and the subscription does not auto-renew.

4.4 Refunds

First-time subscribers are entitled to a full refund within 14 days of their initial paid charge, no questions asked. Email refunds@objektiv.ai from the email address on the account. The 14-day guarantee applies only to your first paid period on the Service; subsequent renewals and tier upgrades are non-refundable except where required by mandatory consumer-protection law in your jurisdiction. Refunds are issued to the original payment method within 5-10 business days of approval.

4.5 Failed payments

If a renewal payment fails, we will retry it for up to 14 days. During this grace period the Service may downgrade you to the free tier. If payment is not recovered within 14 days, the subscription is automatically cancelled.

5. Content ownership and licence

5.1 Your content

You retain full ownership of every photograph you upload and every analysis result generated from it. We claim no copyright, no commercial rights, and no ownership interest in your content.

5.2 Licence to operate the Service

You grant Objektiv a limited, non-exclusive, royalty-free licence to host, store, transmit, display, and process your content for the sole purpose of operating the Service for you. This licence exists only for the duration of your account and the time we are legally required to retain billing records. It terminates when you delete your account.

5.3 No marketing use

We will never use your photos, analyses, or chat transcripts in marketing, case studies, model training, or public-facing content without your explicit, separate, written opt-in. The default answer is always no.

5.4 Our content

Everything else on the Service — the user interface, the underlying source code, the scoring rubrics, the system prompts, the brand assets, and the documentation — is owned by Objektiv or its licensors and is protected by copyright, trademark, and trade-secret law. You receive no rights to it beyond the right to use the Service as intended.

6. Community feedback feature

The community feedback feature, where available, currently uses AI-generated personas rather than real-user feedback. If user-to-user feedback is enabled in the future, it will be opt-in, moderated, and governed by additional community guidelines that you will be asked to accept at the point of opt-in.

7. AI disclaimer — read this carefully

The outputs of the Service are AI-generated opinions based on visual analysis of the photograph you submit. They are not:

• Medical advice, a medical diagnosis, or a substitute for consultation with a qualified physician or dermatologist. Skin observations may flag visible features but cannot diagnose disease.
• Psychological, psychiatric, or counselling advice. The Service does not assess mental health and is not a substitute for a licensed mental-health professional.
• Nutritional, fitness, or dietary advice. Body observations describe visible morphology only.
• A definitive judgement of attractiveness, worth, or social value. The scoring rubric is a calibrated bell-curve heuristic; individual readings can be wrong, particularly when lighting, angle, or image quality is imperfect.

If anything in your analysis suggests a possible medical concern (a mole, a skin condition, a posture-related issue), consult an appropriate licensed professional. Objektiv accepts no responsibility for actions taken on the basis of AI output.

8. Service availability

We operate the Service on a best-effort basis. The free tier is provided without any service-level commitment; it may be unavailable, slow, or rate-limited at our discretion. Pro and Ultimate subscribers will receive advance notice by email of any planned maintenance window expected to exceed four hours. We do not guarantee uninterrupted availability and are not liable for outages caused by circumstances beyond our reasonable control (provider outages, denial-of-service attacks, regulatory action, force majeure).

9. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF ANY ANALYSIS RESULT. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any defect will be corrected. To the maximum extent permitted by law, all such warranties are disclaimed.

10. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Objektiv, its officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to damages for loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of, or inability to use, the Service.

In any event, the aggregate liability of Objektiv to you for all claims arising out of or related to the Service or these Terms shall not exceed the greater of (a) the total subscription fees you have paid to Objektiv in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred United States dollars (US$100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the limitations above may not apply to you in full. Nothing in these Terms limits liability for fraud, gross negligence, wilful misconduct, or any other liability that cannot be excluded by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Objektiv and its affiliates from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your violation of any law or the rights of any third party, including any person whose photograph you uploaded without consent, or (c) any content you submit to the Service.

12. Termination

You may terminate your account at any time from Settings. Termination by you stops future billing immediately and triggers deletion of your data as described in our Privacy Policy.

We may suspend or terminate your account at any time, with or without notice, if we have reason to believe you have violated these Terms or applicable law, or if continuing the account would expose Objektiv or its users to material risk. We will refund any prepaid subscription fees attributable to periods after a good-faith termination by us, except where the termination was for serious breach by you. Sections 5, 7, 9, 10, 11, 13, and 14 survive termination.

13. Governing law and dispute resolution

These Terms are governed by, and construed in accordance with, the laws of [Jurisdiction], without regard to its conflict-of-laws principles. The courts located in [Jurisdiction] shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

If you are a consumer in the European Union, the United Kingdom, or another jurisdiction whose mandatory consumer law grants you the right to bring proceedings in your local courts under your local law, nothing in this section overrides that right.

14. Changes to these Terms

We may revise these Terms from time to time. If we make material changes — a change to fees, a change to your rights or obligations, a change to dispute-resolution — we will notify registered users by email at least 14 days before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not accept the changes, your remedy is to stop using the Service and cancel your subscription before the effective date.

15. Miscellaneous

• Entire agreement. These Terms, together with the Privacy Policy and any tier-specific terms presented at sign-up, constitute the entire agreement between you and Objektiv regarding the Service.
• Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
• No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
• Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of substantially all our assets.
• Notices. We send notices to the email address on your account. Notices to us should be sent to legal@objektiv.ai.
